The law of contracts states that for a contract to arise there must be an offer from one party that should be equivocally accepted by another one. There should be an offeror and an offeree. The offer should be accompanied by a consideration that should be binding between the parties. It can either be written, oral or partially written and partially oral.
In our case, Virtual Sales LLC has made an offer to the Wescott to design an online marketing approach for the company. Wescott has equivocally accepted the offer at a consideration of $ 4,000. At this stage the contract has already arisen because it fulfils all the conditions of a valid contract. Virtual Sales has requested the Wescott to alter the original contract at a new consideration which was too been accepted by the other party.
The contract has been completed within the stipulated time but the offeror has failed to pay the consideration has contracted to the offeree.
