1 Describe THREE (3) different ways by which you could show the role and importance of laws on our society.
There are many reasons why law is important and three on the major reasons are mentioned below:
* The law protects the human rights so that people are fair and clear with each other.
* The law protects the people in harming eachother and allows general audience to live a more peaceful and managed life where they don't have to impose anything instead the law protects them using set of rules that defines what a person can do when he is threaten or mistreated
* Law allow people to have control of their emotions and take legal ,prescribed actions so that people don't have to worry that someone will can benefit from them and walk away easily.
Law protects people, parties and contracts by keeping terms and conditions that are predefined by the government body of particular country. Laws are made on the general assessment of the situation and if any party is not able to follow the rules or break the general assessment or defined law then that party will be held under consideration of defined punishment.
2 Explain the TWO (2) important elements in defining a contract to justify the existence of a contract in the above case.
There are many elements that are crucial and two of the major are discussed below;
* The first element that play important role in the contract is the clarity on agreed method
* The second most important part of the contract is the protection that means if the contract is not followed then what consequences can happen
According to the case mentioned above, the agency agreed upon providing platform for the concert and all the arrangements but in the case study it is not clarified that concert hall must have certain number of seats or will be carried till 2am. These discussions were carried verbally and a verbal agreement doesn't count in the contract so agency is not liable to answer.
3 Based on the above case, describe the manner in which the contract was to be discharged.
The concert was to be discharged on the basis of verbal rules that were not mentioned in the contract. The verbal agreement was that concert hall must have 2500 seats, along with seats the concert must be carried till 2am and it didn't happen. Agency must have followed these simple instructions but due to looking at their profit agency arranged a place which was not suitable for the desired concert.
4 Which of the essential elements of a valid contract would you say is missing in the above case? What will be the effect of its missing on the contract?
The most essential element of a contract is the clarity of the agreement and by the look of the case, the actual terms were not put clearly in the contract and that lead towards downfall of the concert. If these terms were put clearly then concert would have been a success without artist having to pay 120,000 dirham's.
5 Identify and describe the parties affected by the concerned UAE laws in the agency agreement in the above case.
UAE laws define the general contract method and how two parties are liable on described laws but in this case one party has broken verbal law that was of providing defined number of seats and time. There is not any law that defines verbal agreements as legal so that agency will not be responsible for their act and artist will have to pay the consequences. There is a condition where if the terms were defined in the contract then agency would have been responsible for their act.
6 Identify and describe the kind of agent and principal in the above case.
The agents were not professional because if they were then they would have told artists that concert can be possible on the defined set of rules. Agents took the money and take benefit from the artist with the help of a contract that was not clarified. Agent's job was to make sure that they followed instruction properly but instead of following the instruction, agents took extra benefits by arranging a concert hall that doesn't permit what artists were thinking.
