The Canadian Charter of Rights and Freedom
Canadian politics have undergone significant changes, for instance, the introduction of the Canadian Charter of rights and freedom. Barker and Charlton (2015) present the opposing opinions of Robert Martin and Philip Bryden on the democracy status resulting from the Charter implementation. Robert Martin argues that it focuses on the adoption of American ways and disregards the democracy of the Canadian citizens over the authority extended to judges to overturn policies made by elected officials (Baker & Charlton, 2015). On the other hand, Phillip Bryden supports the Canadian Charter. He acknowledges the empowerment of courts to rule on the constitutionality of government legislations that, according to him, has significantly transformed operations in the Canadian political system (Baker & Charlton, 2015). Strong support and criticisms of the Charter remain, allowing one to analyze the opposing arguments critically.
As a judge, I believe the Charter of Rights and Freedom is democratic, and the differing opinions are not well-grounded and can be solved. In my opinion, the permitted judicial reviews on legislation are meant to address modern political and social dilemmas in the constitution rather than the individual values of the judges.
