Briefly, explain the elements of burglary in that statute.
The California’s Statute on burglary is applied in charging any case of pertaining illegal entrance into an owner’s house or even business enterprise with the intention of committing theft (Middaugh, 2015). This statute asserts that in proving that an individual is guilty of burglary, then the prosecutor should be able to beyond no doubt show that that individual entered a certain property with no permission and that he or she had the intentions of committing a crime. The defendant’s intent here could be his or aim of committing larceny. In a case where the defendant did not intend to engage in a crime even after entering the premises, then he or she could be charged with trespassing.
Explain whether Archie could be charged with burglary in this state.
Yes. This is because he entered Reggie’s business premises with permission. In addition, Archie also got access to Reggie’s computer and even transferred some money to his account without the consent of Reggie. Precisely, Archie is guilty of burglary and because this is punishable in California, then he will be charged.
