U.S. residents enjoy the protection against unwarranted searches and seizures carried out by the government by the Fourth Amendment. The Amendment aims to protect people's right to personal privacy (1). For example, inside an individual's house, they expect privacy; in contrast, items the person reveals to the general public and in plain view or on the open ground are unshielded because the person has not shown any intent to keep them private. This paper will evaluate the Fourth Amendment based on a case study, establish the precise theory that applies, and review the validity of the officers' acts in the case.
The Fourth Amendment
The Fourth Amendment, which was enacted on December 15, 1791, provides all citizens of the United States with protection from unlawful searches and seizures of private property; in contrast, items the person reveals to the general public and in plain view or on the open ground are unshielded because the person has not shown any intent to keep them private (2). Searches are investigations ordered to be conducted on property regarded as evidence of a crime.
