In the United States, blood transfusion is considered service and not the sale of goods. Article 2 does not apply to contracts for services, land, intangibles or other items that do meet the criteria of "goods." In a mixed transaction involving both goods and services, the predominant factor test is performed. This test determines whether the purpose is the rendition of service with incidental goods involved or the transaction of a sale with labor incidentally involved. A blood transfusion is an incidental transfer of goods or property made in the course of performing a service. Since article 2 applies to a sale of goods only, it does not apply to the service of blood transfusion.
