The enacted law offends Amendment I(1791) of The Constitution of the United States which posits that “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;…”CITATION Uni22 \l 1033 (United States Senate) The religion that is clearly hailed here is Roman Catholic which offends Amendment I(1791) of the Constitution thereof.
Texas being a state draws its power to enact laws from the Constitution of the United States as provided for under Article 1 Section 1 of The Texas Constitution which envision that, “Texas is a free and independent State, subject only to the Constitution of the United States,…” CITATION Tex22 \l 1033 (Texas Legislative Council) and therefore cannot make laws inconsistent with the Constitution of the United States.
The enacted law offends the Bill of Rights in both the Constitution of the United State and the Texas Constitution. Article 1 Section 6 of The Texas Constitution provides that, “All men have a natural and indefeasible right to worship Almighty God according to the dictates of their own consciences. No man shall be compelled to attend, erect or support any place of worship, or to maintain any ministry against his consent. No human authority ought, in any case whatever, to control or interfere with the rights of conscience in matters religion, and no preference shall ever be given by law to any religious society or mode of worship.
