Statutes That Determine Education Funding in South Carolina
South Carolina has a lot of financial obligations. The monetary challenges faced by this state have made it enact laws that provide for an adequate allocation of finances on educational programs. Therefore, numerous statutes have been laid down to regulate the funding of schools. For instance, the Education Accountability Act (EAA) has been affirmed by the South Carolina School Boards Association (SCSBA) to help in attaining quality education. This act has empowered the management of learning institutions at the local levels to set aside funds for per-pupil expenditures thus raising the standards of pupils’ performance (Kaplin & Lee, 2007). Also, an increase of funds by almost 60% has made it possible for students to access best facilities for their studies.
Research has shown that poor and minority learners attend underfunded colleges due to high transportation costs. In response to this, the state government has enacted a transportation statute to cater for such expenses. Besides, the FY 2010-2013 Appropriation Act assigned funding to lower school districts’ fare on transportation services (Swenson, 2000). It also allotted $ 250,130 for bus drivers’ benefits and wages. Likewise, the government gave support by setting aside these funds to aid in hiring buses and pay for services. However, these services are not limited to delivering the pupils, instructional activities, teachers’ salaries, and comprehensive remediation.
Analysis of Courts Resolving Challenges to State Funding Systems
In the year 1998, four cases were presented in a trial court in Brown v. Boards of Education. The South Carolina’s advocates worked continuously to realize the dream of equal education opportunity. In so doing, they sued the counties alleging that their systems of monetary resource distribution were inequitable and based on many disparities. In November 2004, the court found that indeed there was unequal distribution of facilities and teaching quality. In the same decision, Judge Raymond held that it was important to address the effects of inequality of financing the educational system. He added that this would enhance abilities and achievements of students from humble backgrounds. Additionally, more than seven years after the argument on the allotment of funds, the Supreme Court directed the legislature’s policy-making body to develop specific solutions like cost studies and planned remedial measures for efficient performance.
Evaluation of Courts on Public Funds for School Choice
In reality, courts have progressed in “The Educational Adequacy” of schools. They have ordered addition of resources to both public and private schools resulting in better performance. Indeed, empirical evidence has shown the validity of increased finances which are made available by the virtue of judiciary orders. Again, the courts have put in place the follow-up procedures on how these resources are used within the institutions.
Analysis ofthe Roles of Federal and State Legislation and Courts on Education Funding
As mentioned earlier, the federal agency has played a big role in upbringing education levels. While it did not issue adequate policies in the past, the federal government has recently involved all schools by ensuring equal access to finances and safeguarding students’ constitutional rights by supporting their curriculum projects. Equally, the state legislators have actively participated in education matters in bid to make sure that proper funding at local levels is achieved (Stark, 1991). They are responsible for maintaining public operational funds, regulating teaching methods, curriculum, and graduation. They do this through the enactment of local laws that protect the learning organizations from capital differentiation.
