Intellectual property can be described to be something which is unique that is physically there. The protection entails copyrights, designs, trademarks as well as patents. Intellectual property protection ensures that others do not copy or steal ones’ inventions, designs of products, names of brands or products as well as the things that one has written, made or produced. The violation of the right to intellectual property is the basis of the Sony BMG Music Entertainment v. Tenenbaum. In the case, the defendant had violated that right. The music industry had the copyrights to the music that he willfully shared with his friend even after he had been warned. The young college man had constitutionally been wrong and he had to pay the statutory damages due to the copyright infringement. Ethically, he chose to do an action that he knew was wrong. The college, parents and friends testify to warning him to stop the infringement, but he willingly chose to continue.
The businessman had violated the intellectual property right of the DVD content owner. The materials on the DVD are copyrighted and as such, no part of the content should be copied nor shared to others without the authorization of the content owner (Goel, et al 2010). Therefore, the use of the clip in the PowerPoint presentation was wrong. In the case of sharing the presentation with his colleagues, the Copyright Act also disallows any distribution of any copyrighted works which includes the video clips.
In the event of a business presentation, one’s goal is to have a successful sale pitch. However, it is wrong to use a movie clip despite it being the crucial to close a deal. I would not use a movie clip in a presentation since that is copyrighted material and cannot be used in a presentation without the owner’s permission.
