Bullying can take different dimensions as it can be physical bullying, social bullying, and at times verbal bullying. Bullying can be manifested on physical platforms, and with technology, bullying on the internet is the new norm of bullying. In my opinion, the existing federal laws are not sufficient to stop bullying and confront bullies completely. Some of the existing federal laws that are CIPA, COPPA, and FIRPA. Each of these laws plays different laws in the protection of children in cyberspace.
For COPPA, it is enacted with the aim of protecting children below the age of 13 years (Masterman, 2019). This laws regulated those who operate websites which are intended for children below 13 years. Furthermore, this federal law is intended to regulate anyone else who operates a website with the knowledge that, at some point, such a website will collect personal information from a person below the age of thirteen years. Therefore, these federal laws are there to ensure private credential about such a child is protected against compromise. FIRPA is used for an almost similar purpose, although it is based on school settings. FIRPA is used to ensure that private credentials collected from students through school information systems are protected against leakage or unauthorized access, (Wagman, Blinder, Song, Vignon, Dworkin, Clegg, & Chetty, 2023). Minor should also be protected against the consumption of harmful content on the internet. To regulate what a child consumes from the internet, CIPA exists as a federal law that ensures a child is not fed with harmful content that can incite bullying or can be in the form of bullying (Sibanda, 2020). These three laws largely focus on the protection of the privacy of a child credential. Among the three, it is only CIPA that regulates what a child can access in the cloud space, but for FIRPA and COPPA, these two establishes the protection of private credentials collected from a child.
For this reason, I feel that these three federal laws are not sufficient to protect and fight to bully and cyberbullying in particular. This is because these laws do not address instances where children are attacked directly. Bullying and cyberbullying, in most cases, has nothing to do with personal details. It is manifested on a random basis irrespective of one's personal credentials. If the state has to fight to cyberbully, it has to go beyond the personal credentials of children. The state should enact laws that access bullying and cyberbullying in terms of gender, race, religion, and politics, among others. Having laws that address bullying from this point of view, the state can be able to handle bullying and cyberbullying more strategically.
Different states across America address cyberbullying and bullying in general differently. Different laws are used in different to address that challenge of bullying meaning, those who are held accountable for bullying and cyberbullying are treated differently respective of their state.
