Legal Concepts of Tort
There are two notions serving as the tort basis includes compensation and wrongs. The law of tort designs in compensating the victims of injury and loss due to a wrongful act of another person. During the action of tort an individual or group of people, bring their personal suit on a group or an individual to get compensation or any relief for suffered harm. Tort can be either intentional or unintentional (Ashley, 2004). Unintentional torts involve negligence. Its classification depends on the occurrence of the tort and the circumstances that surrounds the scenario. The legal concepts of Tort include negligence, duty of care, loss, damage, strict liability, vicarious liability, defenses, breach of duty to care, and remoteness of damage.
Intentional Tort against a Person
This form requires intent, a tortfeasor must intend to commit an act, and the effects interfere with the business or personal interest of another person not permitted by the law. Some of intentional tort includes false imprisonment, assault and battery, appropriation, fraud, and wrongful interference. Assault is any action or even words intended to make a person to be fearful of physical harm; poses as a threat. While battery is defined as the intentional and unprivileged touching of another person. False imprisonment is defined as intentional restraint of activities of another person without justifying. False imprisonment poses a threat to the freedom of a person to move without any restraint. The confinement is made possible through physical restraint, physical barriers, and physical force threats. Infliction of emotional distress is intentional acts amounting to outrageous and extreme conduct that result in emotional distress on another person (Ashley, 2004).
Unintentional torts
Unintentional tort is also called negligence. It occurs when a person suffers injury because of another person’s failure to meet the needed duty of care. Here the tortfeasor do not intend to bring the consequences that will happen. The concept of duty of care comes from the belief that is we stay is a society with people, some of the actions can be put up with some cannot. Some are right while others are wrong. In the damages and injury requirement, for one to commit a tort, the plaintiff must have injuries (Calfee, Follows, Maher and Spital, 2000).
