Less Is More Act
Parole process begins when an individual is incarcerated. It involves subjecting those who have been approved for release but still have time on their sentence to a community supervision by the New York State Department of corrections and community supervision until completion of their time. Besides the primary condition requiring people on parole not to commit any crime, they are also required to strictly abide by other conditions such as curfews, travel restrictions, regular check- ins with parole officers, drug testing among others. Violations of these conditions, that do not make up a new crime, are referred to as “technical violations”.
Re-imprisonment of individuals for technical violations is one of the major contributor to mass incarceration. Nearly 40% of individuals sent to state prisons in New York annually are incarcerated for technical parole violations, and not a new criminal violation. The system is also associated with racial discrimination as more black people are confined in New York City jails for technical parole violations than the whites. Re-imprisonment for technical parole violations not only increase the population in the state prison and waste taxpayers’ money but also harm individual lives and their families.
The Less is More Act was introduced in 2018 with an aim of providing much- needed reforms in the sector by reducing mass confinement for technical parole violations, promoting racial equity, ensuring prompt judicial review of parole warrants, allowing people to earn time off their parole terms with their good conduct and strengthening public safety (Schiraldi & Arzu, 2018). The Act will in effect reduce prison population by ensuring compliance which will reduce technical parole violations rate, ensure people subjected to community supervision receive necessary support in the reentry process, promote safety and justice for individual and their families, and save taxpayers money.
