The Due Process Clause of the Fourteenth Amendment states: “No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state
deprive any person of life, liberty, or property, without due process of law; nor deny to any person within
its jurisdiction the equal protection of the laws.” The landmark case of Roe v. Wade interpreted the
Fourteenth Amendment to contain an implicit “Right to Privacy” rendering a Texas statute
unconstitutional, which banned abortions, unless conducted to save the life of a pregnant woman. On
may 15, 2019, Alabama Criminal Code Section 13A-13-7 was signed into law by Governor Kay Ivey,
which criminalizes the administration of an abortion, subjecting the person performing the abortion to
fines and incarceration, “unless the same is done to preserve [the pregnant woman’s] life or health.”

Abortion in most states and countries is illegal and highly prohibited. It is a criminal offence to abort a fetus as is like committing murder. Inasmuch as it is prohibited, there are some situations that it is better the woman does the act. In response to situations where abortion should be allowed, the law ought to allow the woman who seeks the abortion services. In such scenarios, the patient must claim that a doctor has denied her constitutional rights and violated the law. Such patient has the right to sue the doctor. Rights that such doctor has violated include but not limited to right to privacy, right to freedom of conscience and religion, right to nondiscrimination and equality, right to decide the number and spacing of children, and right to liberty.
