Defamation: WIRETIME is liable for libel because the libelous allegations were published in a well- known industry magazine. The defamatory allegations were meant to disparage and injure BugUSA in its trade/business. BugUSA has a right to maintain that its repute shall not be disparaged by defamatory assertions made about it to third persons without lawful reasons. It was also liable for the business tort of deliberately interfering with contractual relations between BugUSA and Janet. WIRETIME was aware that a contract existed between Janet and her employer but nonetheless it went ahead to induce Janet to breach her existing contract with her employer out of malice and with the aim of injuring BugUSA (Dobbs, 1980).
BugUSA was liable for the intentional tort of wrongful imprisonment by its employee. This is because imprisoning Steve was within Walter’s scope of employment as a security guard. Steve’s liberty was curtailed against his will without ample lawful reasons when he was detained by Walter.
