Defamation: WIRETIME is liable for libel because the libelous allegations were published in a well- known industry magazine. The defamatory allegations were meant to disparage and injure BugUSA in its trade/business. BugUSA has a right to maintain that its repute shall not be disparaged by defamatory assertions made about it to third persons without lawful reasons. It was also liable for the business tort of deliberately interfering with contractual relations between BugUSA and Janet. WIRETIME was aware that a contract existed between Janet and her employer but nonetheless it went ahead to induce Janet to breach her existing contract with her employer out of malice and with the aim of injuring BugUSA (Dobbs, 1980).
BugUSA was liable for the intentional tort of wrongful imprisonment by its employee. This is because imprisoning Steve was within Walter’s scope of employment as a security guard. Steve’s liberty was curtailed against his will without ample lawful reasons when he was detained by Walter. Being locked in a soundproof room accompanied by threats of physical injury caused Steve to suffer from fear and anxiety (Speiser et al, 1983).
Contributory negligence: Although BugUSA was negligent for failing to put up enough measures to ensure security in its premises and not replacing the burnt out lights, the crime wave was known to all residents. The vendor was also negligent because he chose to stay in the dock where some lights had burned out despite having prior knowledge of the crime rate (James, 1952). The company will use the defense of volent non fit injuria against Rand because he refused to give a right of way despite knowing that Brian was over speeding.
