Do You Think Doctors are Unfairly Targeted in Lawsuits?
There have been increased cases of lawsuits among health care workers in the recent past. Among the most affected are the doctors, who are targeted by law suits in most cases. Although cases of doctors being sued have attracted rage from the medical community, there is sufficient evidence to demonstrate that the suits do not unfairly target doctors. Lack of proper medical records, failure to get informed consent before administering a vaccine or performing a human experiment, misuse of laboratory samples, and lack of doctor-patient relationship is among the reasons why a doctor may face a lawsuit.
The lack of proper medical records can contribute to a lawsuit for the following reasons. To begin with, the problem may lead to a wrong diagnosis, whereby improper medication may be administered to a patient. In such cases, the death of a patient or subsequent injuries may warrant an arrest of a medical staff. According to Rothenberger (2017), estimates of 34% of doctors have had a medical lawsuit in the course of their career. Therefore, medical experts should care when handling patients to avoid unnecessary lawsuits.
Getting informed consent before administering a vaccine or performing a human experiment and proper use of laboratory samples can also reduce the cases of lawsuits among doctors. When a need for human testing or experimentation arises, there is a need to get the free consent of a respondent or subject. As Toraldo, Vergari, and Toraldo (2015) indicate, violating the ethical principle of informed consent violates medical ethics and can lead to an arrest. However, to determine whether a lawsuit is merited or not, there is a need for actors to refer to the medical code of ethics as well as ensure that there is sufficient evidence to support an accusation.
