Introduction
In the United States, the president's office ensures that homeland security is maintained at the highest level. According to Article II's constitution, the president must execute and enforce a congress-generated law. All the executive departments of the State perform the daily federal government administration. Other administrative agencies such as the Environmental Protection Act, CIA, and heads with the full authority of the president also perform the federal governing administration daily. Often, congress has the power to propose and approve any legislation. However, sometimes the president may consider it obligatory to carry out unilateral legislation informing of president directives. Like democracy, such decisions are contentious. Hence, the actions of the president are not unique. Immigration policies and international agreements molded frequent maneuvers around the constitution's constraints on executive power. Therefore, the purpose of this essay is to examine critical distinctions between executive orders and presidential directives in an in-depth analysis.
Comparison between Executive Orders and Presidential Directives
Executive orders specifically address those within the government only. For example, the executive order intensifying public safety in America ensures that the people are safe. In addition, the executive order aims to perfect the execution of immigration laws by the State. The sanctuary jurisdiction has resulted in immeasurable harm to the people of America, thus, the urge for public safety. Additionally, an executive order must be published in the federal register to legal effect.
On the other hand, the presidential directives only address people outside the government. For instance, in 2017, the president issued an order to congress regarding terrorist attacks in the United States. Through the help of homeland security, information sharing global requirements were established by the State. Therefore, the policy's primary purpose is to protect the public from attacks by terrorists. Additionally, a presidential directive does not require to meet any publication requirement to have a legal effect. Instead, a presidential directive more readily is 'born classified.'
Unlike the executive orders circulated to the agency attorneys or general counsels, which can be accompanied by federal register publication, a presidential directive is selectively circulated through the adoption of advanced routing procedures (Manheim & Watts, 2019). Executive orders are also captured by annual volumes of the code of federal regulations. Where else, the presidential directive is maintained in NSC staff files.
Public Safety Enhancement in the Interior of America Executive Order
This order focuses on ensuring that the people are safe. The executive order directives to homeland security include enforcement of immigration laws of the nation to the public safety and security of the America (White House, 2017). The executive order outlines the enforcement priorities that aim at placing unauthorized persons and families at deportation risk. In addition, the executive order aims at ensuring there is a perfect execution of immigration laws by the State. The sanctuary jurisdiction has resulted in immeasurable harm to the people of America, thus, the urge for public safety. General;2y, the orders for creating an office for victims associated with immigrant crimes pressure the affected countries to learn to accept their nationals(White house, 2017). Furthermore, the executive order will raise cases of immigration prosecutions and also prioritize undocumented immigrants from any removal.
According to the executive order (White house, 2017), it is the executive branch policy to ensure effective displacement of aliens from America and provide any available support to the victims associated with any crimes committed by American aliens. Again, with the aid of the policy, the executive branch should use available resources and systems to ensure faithful and efficient execution of the States' immigration laws. In addition, the branch should ensure that no federal funding is given to any jurisdiction that does not comply with the federal law, except if mandated by the law.
This Executive order impacted homeland security in several ways. Homeland security department shall implement the executive order under the INA. Therefore, the ICE shall enforce the operations based on the executive order by directing the local partners and personnel to make applications to the enforcement priorities (White house, 2017). The main priority for the ICE was to remove all aliens from any potential enforcement.
