Legal Question: Does the federal government have the legal authority to regulate the right to marriage or is this an exclusive right of the states? Marriage refers to the establishment in life whereby two people, especially a male and a female come together, purposely for company. It is thus considered a social structure as majorly it involves the interaction of people who come from different social backgrounds. However, the society today has taken a different angle, in line with their perceptions on marriage, by admitting the similar sex marriage. This has brought many indifferences, especially in the societal as well as the religious institutions, bearing in mind their negative take on the act. In this research paper, I will discuss the necessity of the government to take course, whether or not, on the issues of same sex marriage.
The issue on whether to or not to get married seriously depends on an individual. Therefore, the federal government ought not to have a hand in its deterninance. The rights that are clearly spelt in the constitution thus should be properly looked at and trailed, to ensure their implementation. This can be done by looking at the argumentary factors, underlying matrimonies that are as follows:
Marriage is basically on the feelings that one person has for the other, meaning love. In a situation whereby hatred is the underlying factor, love cannot be easily initiated. This calls for the need of the society as well as the government to see into it that one happily expresses their feelings to those whom they have purposely chosen. This will avoid the eruption of disputes between the couples.
Proper decision- making is required for the running of any given household. These do come as benefits, because one’s contribution is felt in the family, and thus can be easily modified for its betterment. A combination of two people without any restrictions whatsoever, will lead into positive results being yielded, as the freedom of thought will have been fully exercised.
Children are usually seen as God’s goodwill to the parents, or even the society as a whole. Despite the fact that married people of similar sex are incapable of bearing their own children, they can take up parental roles, through practices such as child adoption. In contrast, the government will have a hand as the legal documents needed will be acquired through it. However, it ought not to be a preventing factor for the process of that union.
The unacceptance of the similar sex marriage usually attributes to discrimination, due to the small population sample, that is in agreement with the practice. This factor makes the fatalities feel ignored and not to have any benefits in the community. In most cases, this leads to their withdrawal and inability to mix with others. According to the law, none is supposed to be disgraced, as their opinions will at one point determine the governance of any given state.
Health wise, similar sex marriages will lower the risks of the spread of STDs, especially those that are rooted on the sex category. As a result, the health of individuals as well as their state of mind will be boosted. This in a way will reduce the amount of money spent on the running of governmental programmes, meant to eradicate such diseases.
In conclusion, marriage should be a choice that is based on the individuals themselves, but not the government. Despite the fact of the vices associated with the same sex marriages, more thoughts that are positive need to be considered too. The government as an institution should uphold the factors that are favorable to its citizens, by not focusing too much on their drawbacks.
