Franchising is the system whereby the expansion of business and goods distribution is based on the relationship between a brand owner and the local operator to expand skillfully. Franchising generally happens where there is a franchise and franchisee, whereby the franchisor has little control over the management role. A bunch of laws regulates the whole franchising system to make sure that equity is attained. The paper signifies the franchising system in Kuwait and how the government controls the system. By depicting various components like; intellectual property (IP) for the franchising system agreement, market-entry, registration of franchising, trademark regulations, brand protection, dispute resolution between the parties involved, and the use of franchising regulations, the paper explains the law entitled to the system. How Kuwait law regulates the franchising system The Kuwait government has set regulations in making sure that the franchising exercise goes to help firms develop but not for personal importance. The system is defined to operate based on growing relationships between franchise and franchisee through the set rules. The franchise agreements in Kuwait help in regulating both domestic and international franchising. The Kuwait jurisdiction has made sure that payments for the activity are made to bring a positive overview of the area's businesses. The franchising has been regulated in specific components like: * Market entry The Kuwait government has brought various developments in the market franchising for the past few years. The registration activity is essential since the court can dismiss any false claims rendered by the parties involved in franchising. In the failure of appointing a new agent within the first six months, nullification of the agreement is done by the court to reduce piracy. Therefore, the activity has been done to make sure that the marketing industry in Kuwait is not driven into messes by poor franchising. * Intellectual property for franchising agreement Intellectual property refers to a name given to different creation types of mind, including musical, artistic works, and images. After trademark registration, the owner commences legitimate proceedings to prevent any unauthorized use of the brand.
