Respect for other individual’s property implies to feel and know that we should not use that which is not ours. If by any chance we need to have or use that which is not ours, we need to understand that we cannot use it without the approval of the owner. However, it is something else also. As human beings, we need to recognize, appreciate and take care of other people’s effort. One Mexican president Benito Juarez once said that “the respect to other people’s right is peace”. In the society, we have an obligation to respect and value other individual’s property and only use them with the approval of the owner. This paper discusses the right to respect and value other people’s property in relation to non-sufficient funds checks.
The right to own property anywhere in this world is mostly classified as a form of human right for natural individuals in regards to their possessions. This right to own property is considered as one of the most misunderstood and controversial human rights, both in terms of interpretation and existence. Commonly referred to as NSF check, a Non-sufficient check is a form of a check written to a certain bank account without having enough money to pay. The check will definitely bounce because of lack of money to pay (Barron et al. 12). Business involving properties has nowadays become tricky to transact when checks are involved. Paying for a property through a check is more convenient and safe because one is not supposed to carry the big sum of money around. Therefore, for security purposes a check is good but it has disappointed many people. One good thing about owning personal property is that if faced with a challenge or problem in life it is easier to sell what you have and clear the problem. However, it is very disappointing when you enter into an agreement to sell a property only to get a bouncing check. Take a case of James. He was on top of his career until one day when he was involved in an accident. One of the legs was badly mutilated and the only way to help him was through a surgery, according to doctors. He had just registered for a master’s class which cleared all his savings in order to pay school fees. The only option left was to sell a car he had bought earlier. He approached an old friend called Kelvin. After a brief negations James was to get the check after two days. Therefore, he booked a surgery appointment. As agreed, Kelvin delivered and immediately James deposited the check in his bank. After three working days, the hospital informed James that there was no money paid by the bank, only for him to learn later that the check from Kelvin bounced. It was a disappointment because he had all the trust from his friend. There are some countries that are very strict when it comes to banking laws.
In America, a time came and a section of a text in UDHR was negotiated and most states in the US proposed that the right to assets need only be limited to protection of owning personal property. “Everyone person has the right to the use and enjoyment of his property. The law may limit such use and enjoyment to the interest of society at large. No person shall be deprived of his property except upon payment of just compensation, for well reasons of public utility or society interest. According to the policies established by law, any other form of exploitation of man by another man shall be prohibited by law”.
