Facts: The case background is based on a wrong delivery made to a wrong address, according to the plaintiff Maryangella the alleged corporation FedEX on October 2012 received a package with a hand written address and the sender requested for urgent delivery to the specified address. The package sender in the name of ‘R.Mason’ intended the delivery to be made to L.Topin living in 21 Standish Avenue, in Massachusetts. The employees on duty decided to input the hand written label and produce a printed replica that turned out to be an incorrect address hence after shipping the package ended up in the plaintiff’s home address. The Plaintiff’s daughter ended up opening the delivery and it turned out that it contained to be two packages of marijuana. The plaintiff reported the issue to the police fearing that the owner of the package might try tracking the package threatening her safety and that of her children. To confirm her fears the owner of the package called FedEx and obtained the address where the package was delivered to and the plaintiff’s address disclosed. The man shows up at the plaintiff’s residence with two men and asks if she received the package, the action raised anxiety and fear for the plaintiff and her family.
Issue:
The issue at hand is to determine if there was a violation of the plaintiff’s preemptive rights under the common law. To determine if the defendant - appellee FedEx infringed on the Plaintiff’s-appellants rights to privacy and emotional distress based on the negligence of the corporation. The court ruling on the matter in favor of FedEX on claims that the claims are barred by the Airline Deregulation Act, (ADA), 49 and conclude if they can be affirmed.
Ruling:
The ruling holds as the district court's rationale is drawn from the common law and enforcing the summary judgment. The case that is entirely based on the fact that the burden of proof by the plaintiff fails to raise a sufficient jury question that begs for further investigation.
