A binding arbitration clause is a clause in a contract that states all disputes must be resolved by arbitration.  Should businesses be allowed to contain binding arbitration clauses in their consumer contracts?  Why, or why not?
For the business, they have to be allowed to contain the binding arbitration clause in consumer contracts. The business has to include binding arbitration which is one of the ways that can assist in quick and quiet resolving of the disputes which might arise. By including these clauses, they will assist the business in avoiding the formal court's systems that most of the business usually feel it’s expensive and consumes more time which makes it easier to resolve conflicts.
How does the intellectual property’s law balance rights of creator/innovator with rights of public?
The intellectual property it's serving as a foundation for innovation in the economy. The government granted the right to incentivize the discoveries plus creativity through the provision of an opportunity for the creators to be able to profiting from values of innovative work. Exchanges is where the creative work is being made public for other people to building on besides benefiting from work of an original creators. The laws reduce the transaction costs between the inventors and the industry.
One of the sources of law in United States is the case law, sometimes known common law, that is basing on decisions of the courts. The decisions of the court resolve the disputes in particular cases which is in court, but how could decisions of the courts create the source of the laws which apply beyond case where the decisions was being rendered?
When the decision is made within the court the courts have to create law by relying on the case and the decision made which can be used for future cases. The case can be used as a reference in coming up with the case law that can be referred to when it comes to the determination of the same kind of cases. The courts should establish the individual federal rights based on the federal law in place and the decisions which have been reached for applying beyond the decision reached.
