Cyber Crime Prosecution (Research Paper Sample)

Instructions:

my task was about cyber crime and its impacts,As the use of the internet continues to grow, the threat of cybercrime will continue to increase. Businesses rely on connectivity and data to conduct business. According to a McKinsey report, the internet has an $8 trillion annual economic impact, with the smallest firm able to have an international reach. But despite the economic impact of the web, a lack of legal justification can lead to overcriminalization and moral overreaction.
The costs of cybercrime are rising rapidly, resulting in a large threat to internet users and the global economy. In 2016, IBM CEO Ginni Rometty described cybercrime as the number one threat to every profession. The cost of cybercrime is expected to reach $6 trillion by 2021, according to a Ponemon Institute study. Its findings suggest that organizations that suffer at least one breach during 2016 lost an average of $4 million. In addition, 98 percent of data security breaches are caused by malicious intent.
While the likelihood of detection is low, organized crime organizations are increasing their use of technology and the internet as a means of crime. The likelihood of being targeted by a cybercrime group is less than one percent in the U.S. As people become more aware of cybercrime, they are more likely to commit crimes that may affect them.
There are many forms of cybercrime, including organized crime groups. Organized criminals have a growing dependence on technology to make money, and the use of high-tech crimes makes the internet a tempting option for illicit activities. However, catching criminals using cyber tools is a major challenge for law enforcement. Once boundaries existed between countries, cybercriminals have eliminated them and have become the biggest threat to global society and commerce.
The impact of cybercrime on society is enormous. It has implications on national security, public health, and personal privacy. In the U.S., the likelihood of detection is 0.05 percent. Ransomware is a type of malware that blocks access to files and threatens to destroy information unless the victim pays a ransom. It is now the preferred method of cybercriminals.
Cybercrime is a serious threat to society, affecting not only the real world but also the virtual. For instance, it can impact both the real and virtual bodies. Identity theft is a big example of cybercrime. While the United States doesn't have an official identity card, it uses its Social Security number as a de-facto identification number. Taxes and other private institutions use this number, and the theft of this number allows for a person to gather citizenship documents.

CYBER CRIME PROSECUTION
Cybercrime has been on the rise, however countries such as US have tried unsuccessfully to prosecute the criminals without any success. Millions of dollars are lost from different institutions every year. The crime has been very profitable for the criminals and they enjoy impunity from prosecution. There have been numerous barriers to prosecuting this type of crime. One being challenge being their location, majority of these criminals are located in countries such as China, Russia and North Korea, these countries usually do not honor arrest warrants issued by US and the do not have extradition treaty with US, therefore encouraging the cyber criminals to continue with their illegal activities without fear of ever getting prosecuted, there has been random cases of ransom ware which has forced many US companies to give the criminals huge amount of money ,which usually disappear on the internet without a trace (ALRikabi, & Hazim,2021).
Another barrier which has made prosecution of cybercrime impossible, is that majority of these crimes goes unreported, big institutions usually try to negotiate with cyber criminals and ending up meeting their demands, without ever involving the police in the process, on the other end majority of individuals who falls a victim of this type of crime are usually do not report to the law enforcement(Mallard, & Hanson, 2021).
In conclusion, there is more which still needs to be done to stop cybercrime from occurring, the US should form extradition treaties with countries mentioned above to make it possible to prosecute the criminals.
REPLY 1
Cyber crime cases are growing every day across the world, many criminals have found this malicious act to be profitable because it is easy to target the institutions and siphon huge amount of money without getting prosecuted by the courts. The crime has also been promoted by the fact that many criminals do no report the crime when they fall victim, most of the crimes goes unnoticed in most cases because the victim understands that these criminals are not easy to face the rule of law(Khari, et al,2019).
REPLY 2
In the cyber world it is possible to know the location of the criminals as well as where they transfer the stolen money, however it has been challenging to prosecute the criminals due to the fact that majority of them are located in foreign countries , regions which will never respect the arrest warrant
