In the beginning of the Civil War the legislature established the first provision in the constitution limiting the rights and freedoms of American citizens prohibiting slavery and outlawing private ownership of slaves by individuals (Buchanan, 1974). Before Abraham Lincoln was elected, slavery already existed in the South and in his first term proposals to extend it to the Western regions were already in place (Amar, 1990). Fundamentally, Lincoln did not support slavery and attempted to prevent its encroachment in the Western territories. However, the constitution did not permit the abolition of slavery by the federal government in places where it had already been established.
