Introduction
The contextualization and understanding of the rule of law have drawn mixed interpretation in Irish context. The process has elicited a debate on whether the Irish judicial systems have expressed vagueness in its use. The rule of law is essential in the understanding how Ireland creates its Irish democratic order, and Aristotle once noted that "the rule of law is better than that of the individual.” The rule of law in the Irish reflects back to the concept of AV Dicey understanding and application of how a country can integrate laws within its institutions. The first feature is that judicial processes must strive to meet the supremacy of law. The point is that all individuals within the borders of Ireland, government and individuals, must be subjected to the law as enshrined in the constitution. Secondly, the system has to uphold the concept of justice. The rule of law in Ireland can only be relevant when a country shows interpersonal adjudication or practical law based on procedures. The rule of law remains contested topic but, a country is deemed to have put its mechanisms in order when it follows concepts captured in Dicey’s model. Every country must adhere to supremacy of the law, the predominance of the legal spirit, and all Irish citizens are equal before when subjected to the same legal process. There are existing practical gaps in courts and arms of government in Ireland. The paper disagrees that the notion of the rule of law being too vague to be useful is applicable in Ireland.
