In recent years, there has been much controversy regarding human rights violations in sports, and this comes after several campaigns launched to promote gender equality in sports. However, no legal measure has been taken to help promote human rights in protecting gender rights. When choosing how to protect athletes' human rights, recent years have seen an increase in the focus on promoting those rights, which has led to a regulatory problem. Policy disputes on transgender and intersex recognition have elevated the matter to the forefront of current debates. Because of this change, there are no conflicts with the conventional binary systems of sports such as men vs. women. While the inclusion of non-conformers like intersex and transgender athletes has caused a global debate about science and athletic advantage, a little discussion about human rights and legislation has taken place. The question of combining sporting goals with the preservation of athletes' human rights as they increasingly discover their voice and assertion of rights comes to light. Several female athletes have been victims of injustice in sports because of their biological makeup. Based on an article by Human Rights Watch, Negesa and Semenya female athletes are victims of injustice in sports as they exiled from their respective sporting events due to their sex. My thesis is gender testing in sports since its inception has been subject to critics including the reliability, ethics and validity of tests that have chased away potential athletes and other players from participating in in sports making it unlawful.
This topic interests me because, in recent years, women in sports have campaigned on equal pay and equal opportunities; however, very little has been done on those addressing campaigns. Therefore, by writing this assignment, I aim to provide a comprehensive analysis of controversies surrounding gender testing, which has contributed to discrimination, humiliation, and privacy violation of rights because of abnormalities in human fluids and body structure. This topic is also important to me since, with extensive research, I will be able to show how the human rights of players violated when they subjected to compulsory gender testing. Also, it is essential to research what laws and regulations have been put in place to govern and protect gender testing in sports. With the help of scholarly sources such as journals, articles, and books, I will defend my thesis. The identified five sources will help me develop argumentative and clear explanations to defend my topic without leaving any gaps.
In today's sporting era, gender testing in sports is essential for both men and women. However, the gender test discriminates against humanity because it restricts sports participants regardless of gender. Although reliable, the distribution of chromosomes, hormones, and structures differs between men and women, so sex tests may not give sufficient results. Gender testing in sports is unfair because it is worthless due to the lack of supporting guidelines. The gender test theorem may or may not be correlated. Different gender verification tests will give different results. However, arguments do not consist of consensus when you give different knowledge in the same problem. Sexual testing is considered a tech process because it recognizes activities that benefit physiology "men" by athletes. In principle, men and women with existing experiences in sports are more physics. Similarly, women who participate in sports are men than those who have not participated.
The possibility of a man dressing as a woman is a general norm and is considered ridiculous by both attendees and the general public. It has established that men who aspire to be women in sports will later become men. It creates ambiguity for the external genitalia, probably due to androgens and chromosomes. Women have a single mass of X chromosomes, but men do not. However, some women do not have X-chromosomes. Therefore, the chromatin test unreasonably restricts women with only one Xchromatin from participating in sports. The International Commission on Sports has proposed an alternative assessment, but the follow-up has never completed. Athletes may choose to withdraw and limit their ability to participate in competitions because they could not regain their qualifications. Chromatin test sounds effective but excludes certain competitor scenarios.
Sports organizations worldwide think that human character separated into two genders: male and female. Gender testing techniques are dependent on historical preconceptions and idealism's underlying beliefs. Therefore, this is discriminatory. Due to the gender testing procedure, many candidates will disqualify. Despite the secret consequences, many athletes drop out of competition for fear of not meeting the criteria. Ideally, INTERSEX and TransGender individuals should classify into competitive sports categories. Currency on scientific and medical knowledge is an "objective" judgment of an athlete that participates in the event at event viewing events. In 2011, the International Athletics Federation developed guidelines that differences in athletic performance between men and women primarily lead to higher levels of androgen hormones in men, leading to strength and development. Men's and women's sports separated primarily to create a fair arena and competition. The guidelines developed by the International Athletics Federation proposed to maintain the same fairness and equality as competition, including three-step diagnosis. The first step is a medical history and physical examination. This level requires a series of questions about a person's history, including genetic characteristics, followed by a physical examination by a doctor.
The second level is the endocrine assessment, which requires blood and urine samples to analyze specific androgen hormones. The third level is only needed if levels 1 and 2 return abnormally, based on expectations of biological women. Stage 3 is a complete assessment that includes additional genetic and hormonal laboratory work.
