The article written by Christina Clark-Kazak on March 20, 2022, highlights the importance of children's rights and how war has led to family separations in Ukraine. Clark-Kazak asserts that women and children are the most affected during the war and have to run to the nearby cities and country for their safety. Both the disabled and adults are always left. Children are leaving their homes without their families in a large number, and the government does not know how to effectively and appropriately manage them (Clark-Kazak, 2022). This has led to family separation, thus posing legal and social challenges that every government needs to address in age- and gender-sensitive ways.
Additionally, Clark-Kazak argues that there is a need for governments to come up with specific protection and care for both unaccompanied and separated children due to their developing capacity to care for intergenerational power hierarchies. Society does not allow children to control resources or participate in decision-making fully. They are always given fewer opportunities to air out their rights and well-being, even though the United Nation Convention on children’s rights requires all decisions affecting children of all kinds should be guided by the best interest principle (Clark-Kazak, 2022). During this wartime, the Ukraine government needed to use this principle to evacuate children in institutional care, such as orphanages and hospitals, to ensure children are safe and not separated from their families.
Lastly, people living in Ukraine are likely to experience severe mental and health problems during and after the war. Clark-Kazak asserts that young people, particularly girls in single-parent households, take on additional child care, paid labor, and household to support their relatives and families (Clark-Kazak, 2022). However, it is difficult for them to perform this additional child care at this time since everyone is looking for their safety.
After reading this article carefully, I think there are many things that the government of Ukraine and the entire society need to develop legal measures to protect children, young people, people with disabilities, and older people from getting affected during the war. It is evident that both secondary and tertiary migration continues to occur in Europe and other regions as the violence and displacement continue in Ukraine, thus causing particular legal and immigration challenges for families helmed by women whose husbands are not allowed to leave the country.
