Chapter 1 Summary: A Juvenile Delinquent
The first chapter presents the notion of childhood social formation and analyzes the challenges underlying a child's smooth transition to a legal system. The notion of parens patriae, and the concept of the juvenile offenders as a mechanism of last recourse, are also discussed (Delgado et al., 2017). The chapter also describes how criminality and delinquency are assessed, with a focus on National Crime Records bureau, self-report research, and vulnerability surveys. A taxonomy of juvenile offenders is also examined, as is the measurement of kids as victims as well as delinquents.
Childhood's Social Construction
Age is a socially assigned attribute, and society treats people differently based on their age. Due to their physical, cognitive, and emotional growth, several factors are utilized to treat minors differently from adults. Juvenile delinquency also refers to minors who break regulations that are solely applicable to minors and would not be regarded a crime if executed by an adult. The term "parens patriae" was first used in English History. The legal groundwork for the government to interfere in families to safeguard children was laid by Parens patriae. For two main reasons, the United States' legal system expanded parens patriae to adolescents. To begin with, not all parents had sufficient influence on children. The secondary benefit was to safeguard children from parents who were abusive or negligent.
Delinquency Measurement
Not all bad behavior is criminal. Criminal crimes are infractions of the legislation and represent the most severe form of social supervision. The court system does not accept violations of norms and regulations.
