The regulation put in place only allows an excavator to enter into a trench of fewer than five feet without a trench box.it enables prevention of cases of being buried in the trench, it's a preventive measure. If the crew is allowed into the trench without the protective gear, their lives are put at risk since their security is guaranteed in case of anything(Desjardins,2007). Just because Jerry did it before without this measures and nothing happened, they shouldn't try their luck since it has also buried people in the past. The limit to which the crew should be allowed into the trench is Five feet only.
Ethical grey areas
There are several instances in this scenario where ethical issues in conducting a business arise. Jerry and his crew of excavators didn't bring with them the trench box and yet it is one of the tools for their line of duty. It indicates unprofessionalism on their part in conducting their business. The city administrator wants to put the life of the excavators in the line of danger, by not giving them a choice yet they don't have the appropriate equipment to undertake that duty. He also goes ahead and threatens jerry which also indicates rogue ways of negotiation while conducting business. Just because the city council members are served by the sewer line is not any reason that should be tolerated so as to go against the set rules and regulations. One of the workers claims that the work can be easily done without the trench box. It is a very wrong assumption, sometimes the experiences people have may fail them and the only fallback plan will be the trench box (Desjardins, 2007). Simply because there isn't any jurisdiction in this area that enforces the compulsory use of protective gear it shouldn't warrant acting outside the organizational policy since it promotes ethics and professionalism while in the line of duty.
The right thing
The excavators should follow the regulations in place to its latter. They should use a trench box since the trench is seven feet deep, therefore, wait for six hours for its arrival and proceed with the replacement of the sewer line. The city administrator shouldn't encourage the crew to enter without a trench box by giving them ultimatums which are hard to meet. Rather, he should as a good leader, allows them to conduct their duty with their security in his mind (Carol &Buchholtz, 2014). During partaking of the excavations assumptions should not be given any chance. Security and safety of the individuals should be paramount and not a topic of discussion.
