Introduction
Capital punishment is legal process where a person is put into death penalty by government or state as a punishment for crime committed (Ornellas, 2014). It was used in ancient and even today it is used in many countries to punish various criminal but still the topic remains a debatable issue in the Criminal justice system.
DISADVANTAGE OF DEATH PENALTY
* Does not rehabilitee individuals
What do we correct after killing the victim of the offense? Does the person learn? The person who committed the crime is already dead and cannot be brought into life. It is believed that when a person feels the "pain of death," it will make other people take it as an example and prevent them from committing the offense (Ornellas, 2014). Sometimes this does not work because most of the crimes are done out of passion when a person is unable to think rationally. Therefore, it is difficult to argue that a person can think of fear when in the heat of passion (Ornellas, 2014).
* Failed as prevention
Research by criminologist has proved that when an execution is made public, various murders follow within a week, e.g., in the Linberg Kidnapping. Many countries adopted this sentence for such offense, but many cases increased afterwards. (Berk, 2009) asserts that publicity may sometimes encourage crimes instead of discouraging.
* The fear of death doesn’t reduce crime.
The research shows that the capital punishment has never reduced crime. There are different death penalties which have been made public with the victims being killed under harsh conditions, but still crimes are common this clearly shows that the act does not prevent crimes. However, people may weigh the arguments and the empathy of the victims in favour capital punishment (Glasner & Twersky, 2007).
ADVANTAGES OF DEATH PENALTY
Crime rates Increase- Due to the crime rates of killing kidnapping and rape, this punishment is conducive for the offenders in order to reduce and serve other as an example.
Death Fear- It is naturally evident that people are in fear of death. It is a trait that every person will think death before acting. Sometimes people claim that Capital punishment results in killing of innocent victims, this fact has never been proved to be true (...
