Unlike the US, the criminal justice system in China responds to status and class differences; it is arbitrary and has been highly influenced by politics. Some reports among western scholars indicate that in China, judicial decisions are never reported to the public due to lack of a reporting system, unlike the US. In some instances, there is an absence of criminal codes and non-publication of fundamental laws, and if they are published, it is in a vague manner (Pfeffer, 1968). In such a system, legality can be doubted, unlike the US that has published substantive laws. Classification of criminal law in China is clear, especially when dealing with minor crimes. Administrative rather than judicial institutions tend to handle such issues. In the case of judicial system involvement; especially in major crimes; the style is different from that of US. The defendant has little chance to defend themselves through a lawyer or directly. In China, most proceedings that are determined to be as close to judicial systems in the US are not public. The judiciary is not independent and can be viewed to have little powers. It seems that the police controlled by the strong party at the moment dominate the criminal process.
