Synopsis of the Case
Costeja, in a casual “google” search of himself, was surprised to find a brief legal notice relating to his bankruptcy case more than a decade earlier. The damaging piece of information was no longer relevant since he had fully resolved the issue several years earlier. Costeja wrote a letter to the local newspaper that covered his bankruptcy case (La Vanguardia) to erase the document as part of his rights under Spain’s data safety laws. La Vanguardia claimed that the auction notice had been publicly posted and the damaging information was therefore public records. Costeja wrote to Google Spain to remove the article but they referred him to the parent company, Google Inc., as it was responsible for developing search results (Class Textbook, n.d.). Realizing that he was at a disadvantage in a lawsuit against the industry giant, Costeja turned to Spain’s Data Protection Agency (SDPA), which agreed to help him enforce his right to personal data.
Relevant Factual Information about the Problem the Organization Faced
The decision the organization faced was deciding whether Costeja’s right to privacy trumped the public’s freedom of information. Although the Madrid lawyer had a legal basis to take control over his personal information, removing the article in question from the search engine would be suppressing the public’s freedom of speech and access to information. The organization had to find a balance between the two privileges.
