Discrimination of any kind is morally wrong (Alexander, 2012). It can be based on race, colour or against a particular ethnic community. It goes against the basic fundamental principle of equality which dictates that all people be treated equally irrespective of their background. All these are irrelevant when considered in the delivery of justice. The essay seeks to illustrate how to eliminate discrimination within the criminal justice system.
For justice to prevail within the criminal justice system, some laws need to be amended, and others eradicated. Laws meant to hold certain groups captive should be eliminated. Such laws target certain groups and individuals indirectly by penalizing acts. These offences can only be committed by people from a particular background. For legislation to apply, either way, they must satisfy the fundamental principle of proportionality (Harr & Kingsbury, 2014).
Sensitization needs to be carried out at all levels of education. Appropriate training regarding human rights, friendship, respect and tolerance among races and ethnic groups needs to be done. All those working in the justice system starting with the police personnel to judges needs to undergo rigorous training as these will aid them in achieving this goal of eliminating discrimination within the judicial system (Stuntz, 2011). If all these official does their work to the later, maintaining discipline and equality before the law, then, discrimination will be a thing of the past.
An autonomous national institution tasked with monitoring and tracking unnoticed cases of discrimination within the judicial system need to be put in place (Fonte, 2011). Such organizations will help in finding cases of discrimination and submitting their recommendations with proposals to aid in the improvement of the justice system to relevant authorities.
