On the 26th of October 1987, a suit was filed by a plaintiff in the Macon County circuit court against jewel companies who are the defendants, Osco Drug, and Inc. The complaint was later on dismissed on the motion of the accused a complaint was amended and filed against the specific defendant who also, later on, acted to deny it because the state had failed to give the cause of action.
(Ill. Rev. *731 Stat. 1987, Ch. 110, par. 2-615.) On the 2nd of March 1988, the motion was allowed by the court and the plaintiff was given a chance to amend. In 1988 March 2, the court entered ruling for the defendants (R., 1863, p. 2).It was determined that the counts contained allegations concerning the cause of actions and also purported to impose liabilities basing on the allegations that don't set a tort.So the order of dismissal was reversed, remand for more proceedings with instructions ordered stricken off the complaint.
