Each country has an established justice system that should be followed. It acts as a guide and how the convicted should be handled during their trial. What is important, however, is to ensure the rights of the accused are not violated. The laws and regulations of the justice system should ensure a fair trial has been achieved. In this paper, an examination of the Japanese criminal justice and the U.S criminal justice has critically been examined especially for the criminally accused during the pretrial stage. The paper also defines the respective emphasis and de-emphasis of procedural justice and substantive justice impact the fairness of each system when in trial and the society at large. In addition, the paper covers how the Japanese ensures the protection of the accused rights, and the Code of Criminal Procedure that protects the rights of the accused and the existence of a more component of substantive justice in the U.S justice in plea bargaining context. The comparison of the Japanese criminal justice system and the U.S acts as a guide for re-examining the U.S criminal justice so that it could serve the public in a more fairly manner. The difference between the two criminal justice systems permits a renewed look of the U.S system (Desombre, 1995). The changes of the public attitude on crime and administration of criminal justice in America is also essential to reassess the insistence value on procedural justice. Moreover, the analysis of the Japanese criminal justice system, which for a long time has been criticized for compromising the accused rights, serves as a guide to reassess the significance and limitations of its own system.
The U.S criminal justice system is considered to be a procedural justice. According to the constitution, it is highlighted that a major way of protecting the constitutional rights of the criminally accused personnel is to make the system procedurally just. In addition, it is established that when the accused has a full procedural protection, it is possible
