The American constitution and the resulting amendments’ guarantee equal treatment of all citizens and spells out the basic rights of all individuals and how they should be protected. The government, through the law enforcement agencies, has a responsibility of ensuring that all the citizens and aliens are protected from illegal and harmful activities that are likely to impact negatively on their lives. The Fourth Amendment of the US constitution was enacted to protect the citizens’ privacy from the government’s intrusion. It provides that every citizen has a right to be secure in their persons, property, and documents and there should be no unreasonable searches and seizures. No warrants should be issued unless on probable, cause and even then, they should be supported by an Oath or affirmation describing where the search should be conducted and what can be seized. The judicial system is entrusted with ensuring that justice is administered and that the law enforcement officers act accordingly while enforcing their duties. This paper provides an analysis of the Fourth Amendment’s Exclusionary and Fruit of Poisonous Tree Rules, and how they were applied in the Katz v. United States (1967), Kaupp v. Texas (2003) and Payton v. New York (1979) cases.
