A tort can be defined as “act or omission, other than a breach of contract, which gives rise to injury or harm to another, and amounts to a civil wrong for which courts impose liability” (Legal Information Institute, 2020). The harm must be specific to an individual and be demonstrated before a competent court of jurisdiction that it actually occurred. Damages arising from torts are measurable and can be proved. According to Law Explorer (2015), “civil rights are correctly construed as individual harms, whereas criminal acts are seen as a public harm, an action against the society as a whole that injures the public peace or public good.” The basic principle of tort law is to atone the casualties for their loss, set a precedent that will most likely deter similar behavior in the future, and register the society’s displeasure of the conduct being prosecuted (Law Explorer, 2015). The defendant in a civil liability case becomes liable to economically restore the plaintiff’s physical and emotional loss to make them whole again. Tort constitute intentional conduct that results to individual harm. The common types of torts include assault, battery, false imprisonment, abuse of process, conversion, malicious prosecution, deceit defamation, intentionally inflicting emotional distress, negligence, invasion of privacy, and trespass (Law Explorer, 2015). Therefore, the remedy for torts is monetary compensation to the victim.
G4S Secure Solutions private security personnel can be affected by torts in various ways. Private security personnel are not immune to tort suits since they are considered to possess the same rights as private citizens. However, their actions and the environment in which they operate exposes them to risks of civil liability proceedings instituted against them. Where a plaintiff alleges and proves that either assault, battery, false imprisonment, intentional infliction of emotional distress, or malicious prosecution were committed by private security personnel, the person in question is liable to civil suits. Damages awarded to plaintiffs by a jurist or jury are quite high which makes tortious conduct costly. The resulting economical loss is injurious to the security personnel’s financing standing. The exact amount of money that security personnel and their employers incur as a result of civil proceedings is not easily quantifiable, but it is estimated that they lose millions of dollars annually in such suits (Law Explorer, 2015). Private security personnel who are found culpable of tort offenses are at the risk of losing their jobs and even having criminal proceedings instituted against them. Torts not only make them lose their credibility and integrity, but they can also affect them emotionally due to the resultant challenge of getting a decent employment. Moreover, a tort case can hinder an individual’s career progression. Therefore, private security officers should be cognizant of the effects their actions committed in line of duty have on their careers.
