Introduction
The International Court of Justice (ICJ), commonly referred to World Court, is a principal organ of the UN. It was established in 1946 and it has its headquarters in The Hague, Netherlands. The court is a replacement of the Permanent Court of International Justice, which functioned before the Second World War. The court has jurisdiction upon all the cases corning disputes based on international law. On the other hand, the International Criminal Court (ICC), is an international court which established by the Rome statue. It was given mandate to investigate, prosecute, and try people accused of serious crimes in the world. It was established in July 2002 in Rome, and it’s headquartered in Hague, Netherlands. The primary purpose of establishing the ICC was to punish major atrocities in the world, which went unpunished. Some of these crimes included the Rwandan Genocide, crimes against humanity in the former state of Yugoslavia. This essay will discuss how both the ICJ and ICC are liable for the jurisdiction of the Gambia vs. Mnymar case.
