The constitution forms the basis for the relationship between citizens and the government. Nevada's constitution protects the people by making it difficult for legislators to increase taxes. The constitution requires a two-thirds majority to pass a bill that will create, raise or generate public revenues. The proposed bills will increase public revenues, thus subject to the two-thirds constitutional requirement.
The citizen should sue and challenge the two bills in court for violation of the constitution. The first bill extends the collection of technology fees made by the Department of Vehicle on specific transactions. The second bill eliminates revenue triggers meant to reduce payroll taxes and extend the prevailing rates indefinitely (Rash, 2019). The bills' impact will include an increase in public revenue, and thus, it cannot be passed by a simple majority (Metz & Ritter, 2020). The increase in public revenue under the bills triggers the two-thirds requirement by the constitution. Therefore, enacting the bills by a simple majority violates the constitution, and citizens should sue to have the bills overturned.
The tax increase does not adhere to the letter of the law, and thus, illegal. The extension of technology fees levied by the Department of Motor vehicles in the first bill will create or generate public revenue (Rash, 2019). The elimination of a scheduled tax reduction has the same effect as increasing taxation in the second bill. The legislature should not focus on the artificial legal distinction of the two bills but their economic ramification (Rash, 2019). The two bills will increase the burden to taxpayers making subject to the two-thirds provision of the constitution. Therefore, the increase in taxation is illegal and should be nullified by the court.
