In the recent days, women in the United States have been regularly prosecuted for endangering their unborn children. To say the least, some have been convicted of murder. This had led to massive demonstrations by thousands of women and liberal groups such as the National Organization for Women as well as the American Civil Liberties Union’s (Finer, & Zolna, 2011 p479). This raises the question, “who has more rights between a pregnant woman, fetus, and father among others?” I believe it is the fetus.
This issue has been highly contested leaving the society devoid of a definite answer. However, the law has been inclined on the unborn child hence failing to approve abortion in most times. In an attempt to protect the rights of the fetus, women in the United States have being dragged out of hospital beds while bleeding into prison cells shortly after giving birth (Warren, 1973 p46). Others have been charged with homicide following still births, pinned to hospital beds and forced to have cesareans against their will. In addition, others have had their babies removed at birth after testing positive for alcohol or drugs (Roberts (1991 p 1422). Roberts (1991 p 1426) further states that “since the mid-70s women have been arrested for these transgressions, and 30 states now have fetal homicide laws.”
According to anti-abortionists, pregnancy is sacred and must not be tampered with (Tribe, 1985 p3). Also, over 99% of all pregnancies are as a result of sexual relations in which both parents participate willingly; one is rarely coerced into pregnancy(Finer, & Zolna, 2011 p482).While pregnancy is a temporary condition, abortion produces a permanent condition-the death of a child. Therefore mothers who perceive their pregnancy as unwanted or difficult can always wait to give birth and surrender the child to foster parent or hundreds of people who are ready to adopt infants. Further, as long as the unborn are human beings, they thus have a right to live since the right to life supersedes the right not to be pregnant (Warren, 1973 p59).
