Introduction
The primary purpose of the establishment of copyrights laws was to promote useful arts and science. Moreover, in the digital era, the copyrights law stipulates that it is illegal to commit audio or video piracy through copying artists’ music without paying the artist (Lindenbaum, 1999). However, the emergence of digital sampling that allows musicians to utilize sounds from existing recorded works and incorporate them into a new work. Digital sampling has resulted in a significant amount of challenge in the existing copyright law framework (Miller, 2017). The search and need to create a balance between artist protection against audio piracy and promotion new artist's ability has led to a great deal of legal controversy within the music industry. Courts and laws decisions have failed to establish the right balance between protecting the original artistic works and protecting new artists without compromising the overall music creativity in America.
Contemporary sampling technology gives the artist the ability to copy portions of already sounds and incorporate the sounds into their new work. Currently, an estimated third of the top 100 best performing albums in the U.S use artistic sampling tools (Lindenbaum, 1999). Pop and Rock artists use sampling technology because it reduces the costs required to hire live bands while saving time for production.
