The legal issue in the situation is whether Anne can be held liable to pay damages for the death of a child through the hit of her car.

Under the Umbrella of US civil law, a death suit can be brought against an identifiable defendant and such suits are the counterpart to criminal charges. In US tort law, negligence is defined as such acts which in similar circumstances, a person having ordinary prudence would not have committed. To prove negligence in tort law, the existence of a duty of care is necessary (Gardner, 2017). From "Richards v.
