This paper will show my experience in the legal system as I communicated with one of the public prosecutors in Texas. The public prosecutor’s office is very busy as they liaise with the police department to address the issues regarding the law. I got a chance to interview one of the public prosecutors so as to have a feel of their work when he was free.
The public prosecutor revealed to me that the justice system was biased when dealing with most of the cases. The suspects that were brought to the court even before their case could be heard, there was a high probability that they would be found guilty because of their ethnic or cultural differences. Most of the convicts brought in the court were Black or Hispanic and the jury over time has associated this person with criminal activities. The White suspects that came to the court may easily sway the jury to decide that they are innocent and walk out free even if they are innocent. The appearance of the suspect brought to court has a very high effect on the verdict that will passed in the court. There are those that have their body covered with tattoos and piercings and most of the time the jury tends to find them guilty of the crime that they are accused of. Most of the Black people that are brought in the court find it hard to control themselves and have difficulty communicating proper English without cussing. I thought that the public prosecutor was telling the details as a stereotype until I went to one of the cases and witnessed for myself. The public prosecutor explained to me that most of his friends that are defense attorneys find it difficult to work with some of the suspects especially the Black. The Hispanic are respectful to their defense attorneys and call them by their surnames while the Black suspects refer to their lawyers by their first names without even a title. Majority of the black suspects have not received quality education and when they are addressed with vocabulary that they do not understand they become very angry as they see that the lawyer is showing off superiority. In the justice system, I observed that racial profiling has a major effect on the conviction rates in the USA as the prosecutor handed me a report showing the statistics of the inmates that are found in the correctional facilities.
The prosecutors work closely with the police department and as I conducted the interview a lot of police came to the building either to bring evidence or for casual visits as the work relationships have made them become friends. In some of the cases that the police officers may face in the court of law is biased. The prosecutor explained to me why this is so because of the relationship that has been fostered even if the officer was on the wrong side of the law. The prosecutor is forced to drop the case so as to save the officer. These two departments the prosecution and the police usually owe each other favors which end up disrupting how the justice system is supposed to be conducted. The prosecutor told me that sometimes they have to refuse cases brought up by the police officers to reduce the cases brought up in the law courts. This is either done because the judge does not want to convict suspects because of the high number of prisoners that are continually brought in. Rogue prosecutors have been found to use evidence that has been coarse out of the suspects or have their friends from the police department to plant evidence so as to incriminate them. They do so because they want to win a lot of cases, and they are probably eyeing an office of position such as being the mayor or the governor by gaining reputation. All this information the prosecutor I interviewed revealed through a report from the human resource department of the public prosecutor office.
The prosecutor handed me a report on extrajudicial killings that were conducted by the police officers. Most of the people that were killed were the Black people who were suspected to be gangsters and most of the cases were not brought to court. The legal system was kind of protecting the police officers that had committed this act of murder. Tribunals would be conducted and the end no action could be taken to the police officers only reports being filed up. I went through various files to see the different cases and the majority the officer that was involved was a male officer. The other challenge I observed in the legal system is prosecution a prosecutor who has broken the law.
