‘’Should chimpanzees be given the same legal status as humans’’
It is true that there are millions of animal species that exits in this world. Many researchers have studied these animals more than a dozen. According to many of the discussions of the researchers and scientists it seems that various apes, elephants, and cetaceans truly posses the Nonhuman Rights Project cognitive abilities, although these are considered as believes that supports the legal person hood. The aim of writing this paper is to discuss why the chimpanzee should or not be given the legal rights as human. Actually “chimpanzee are considered to be special creatures compared to personhood in terms of the similarities,” that are quite sot of breathtaking.
According to (Wise, 241) chimpanzee should not be given the legal right of personhood since it is not entitled to human rights; this was the decision that was made by the New York appeals court. The unanimously ruling was made by the panel of three-judge Appellate Division; they came to a decision that the owner of Tommy, a chimpanzee is not entitled to release him because the animal right groups has considered it to be unlawful detention. Basing on the decision made the judge left one of the favorite quotes as he applauded the colleagues at the Nonhuman rights Project for being able to break a historic ground that was new. The judge said “He cannot pretend to understand the moral universe; because the arc looks to be a long one, while his eyes reaches little ways; he also said he cannot calculate the curve as a complete figure by the experience of sight, but he can divine it by conscience. Using the example of Tommy chimpanzee it is true that chimpanzee does not possess legal human right. However, even if the chimpanzee is imprisoned in the cage its responsibility cannot be compared to that of adult human since the right of legal person hood exits because of the “responsibilities” hence accordance of this responsibilities to a chimpanzee is not valid. In addition, the chimpanzee may be intelligent, but to guarantee it the legal implications of having person hood really does not exist, since unlike human beings any legal duty that a human bears a chimpanzee cannot hence submitting it to responsibilities that are societal should be held based on their actions (Wise, 241).
According to (Boyle,169) it sounds incredulous that the movement which exists among the chimpanzee is more demanding for them to be included in the class of humans, but such a demand is being just promoted within the United Nations. Concerning this issue, it is like we are granting human rights to apes but not bearing in mind the ethical treatment of animals by the humans. It is true that such rights may sound high minded, but they are likely to be similar. Humans across the world are granted certain rights which are closely to those of their counterparts the animal kingdom. These rights include, free press, privacy, free speech, right to religious freedom, right to work among others. If you narrow down to this rights you might discover that chimpanzee are not in position to have this rights even anywhere in the principle of apes.
