Objective Memorandum Law Research Paper Coursework (Other (Not Listed) Sample)
We are to only use Westlaw, LexisNexis to look for cases. Unless you have another way of finding them then that's fine too, I just need them cited correctly within the memorandum. The memo addresses the issue of whether under the New Jersey jurisdiction; Mickey Foster has the right to equal share as the other siblings of Frank and Fran to their foster estate.
BRIEF ANSWER
Yes- the foster parent, Frank and Fran did not accord the plaintiff (Mickey), a formal adoption since there was no court proceeding revealing the adoption of the plaintiff. Also, the foster parents passed away before writing a Will document to show the intestacy share of the plaintiff from the foster parents. Frank and Fran offered foster care to the plaintiff, three years after the death of the plaintiff’s parent and made a verbal and public promise of adopting the child in the future. However, this was not met by the foster parent due to the unexpected death tragedies that found them unaware.
The defendant (Darlene) drafted a letter to the plaintiff indicating that he (plaintiff) should only get $1000 as the intestacy share. The plaintiff uses this letter to base his argument in demand for full equitable share of the foster estate. Additionally, the plaintiff has no legal prove to be the sibling of the Foster parent, but through previous verbal and intended promises by Frank, he has the right to inheritance. The public people and the attorney to whom the foster parent reported their intention of adopting the child (Mickey) should be used as witness in the case.
