According to S.J. Res 23 (107th), “The president is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons…” These are some of the clauses the United States has used to defend the legality of its wars against nations such as Iraq. However, there continues to be a controversial debate regarding whether the battles staged by the United States against her enemies is legal or illegal. Despite the controversies associated with the wars, the United States continues to wage numerous wars with dubious legal sanctions in domestic or international laws. In the Mideast region of the globe, the U.S. militia stands astride and has continuously been accused of the increasing rogue wars. The paper comprehensively analyzes the legal and illegal battles staged by the United States against her enemies, including whether these wars were just or unjust.
Illegal Wars
U.S. War on ISIS
The American’s war with al-Qaeda is one that will go long in history due to the nature of the devastating effects involved. The Islamic State of Iraq and Syria (ISIS) began as an al Qaeda splinter group. The group aims at creating an Islamic state known as caliphate that extends across Iraq, Syria and beyond. ISIS is implementing Sharia Law, deeply rooted in 18th century Islam that seeks to establish a society that mirrors the ancient past of the region. ISIS is known for massacring thousands of people at a go and conducting public executions and crucifixions among other evils. The war has metastasized into many different forms, and surprisingly, the legal courts have only addressed the legality of a small piece of it.[Kaufman, Brett. 2019.
