Intellectual property assets are defined as the creations of the human minds that individual rights are recognized. Innovators, business owners, and artistes are awarded certain individual rights to a variation of intangible assets for certain duration. A good example is where business owners are awarded individual rights on the utilization of their trademarks and geographical demonstrations established by them. Intellectual property is an intangible asset to an organization and it gives financial organizations and business partners the conviction to invest with the institution (GEORGE, 2012).. This paper in a wider view will look at the risks to intellectual property when utilizing cloud computing by analyzing how organizations and individuals usually use cloud computing services and how this usage increases the risks to intellectual property.
Cloud computing is a term that outlines a huge range of services. Many individuals and vendors are using cloud computing for products found outside the usual definition. Organizations and individuals can choose when, how and where to use cloud computing because it is a huge collection of services (BAHGA & MADISETTI, 2014). Cloud computing exist in three different types namely Platform as a Service (PaaS), Software as a Service (SaaS) and Infrastructure as a Service (IaaS).
SaaS is deployed over the internet, and the service provider licenses an application to customers as a service on requirement via subscription. However, the provider may also provide the service at no charge when there is a chance for generating revenue from streams such as advertisement other than the user.
PaaS allows development of web applications rapidly and easily without the complication of buying the infrastructure and software beneath it. It is generally a platform for the creation application administered over the web (BLOKLAND & MENGERINK ,2013).
IaaS provides cloud computing infrastructure- operating systems and server, storage and networks as service in demand. Users buy the resources as a service on demand that is fully outsourced.
Deployment of cloud computing in organizations and by individuals has some risks to intellectual property. The most common risk is the privacy and data protection. The most paramount area of risk and concern in relation to cloud computing services is security and data privacy.
