Marble Transporters is a transportation company dealing with the transportation of people and goods in different parts of the country. The company owns trucks of different sizes and capabilities, vans, buses, saloon cars and containers. The company also hires train cars and private jets or aircrafts for rail and air transportation when necessary. The business has five locations in the country with 7 other smaller branches or offices located in some of the areas where the company has a large number of customers. Marble Transporters also plans on opening more branches and even expanding to the global market in the future CITATION Stu05 \l 1033 (Madden, 2005).
The business serves organizations, companies, other business and even individuals who need large scale transportation services. It deals mostly with the transportation of raw materials, finished products, imports, exports and also relocation of business premises. Individuals in need to moving services can also get the services they need from the company. The company also provides transportation services for tourists and other people in need to car hire or leasing services. The business has a wide range of employees ranging from the management, accountants, human resource managers, procurement and logistics managers, marketers, and drivers.
Some of the tort risks or problems that arise through the operations of the business include: Disparagement especially when there are errors in the specification of the type or quality of goods being transported, and this results in the loss of products or business to the customer. In some cases, the company’s staff may also give fake negative reviews of the products or goods that they transport hence causing legal problems with the customers.
The other tort risk that arises from the business is computer tort and this involves damage of computer or other hardware being transported by the company. This also includes negligent use of computers by the company’s staff when handling the company’s operations.
Unfair competition, or copyright or trademark infringement is also another tort that may arise from the business. This is common in the transport business as most of the services offered by the business are similar to those offered by other transportation businesses and the description of services may tally with those of other businesses that were in operation long before Marble Transporters.
