Religion is one of the most controversial topics in the education sector. The controversy arises due to the conflicting expectations of the First Amendment to the Constitution. The amendment protects the right of every citizen to freedom of speech and religion. Accordingly, in a school environment, educators often face dilemma in balancing the right of students to freely express themselves and the Establishment Clause that bans promotion of any religion in class. For example, in an assignment in which I expected learners to write an essay and submit a picture of the person that the students considered their hero, a student submitted an essay on Jesus and a drawing of the Last Supper. As guided by previous Supreme Court rulings, I will not grade nor display the essay on the classroom to protect the First Amendment rights of all my students.
I will not grade the student essay to protect myself against the legal issues that may arise. Grading the student essay may imply to other children that I am promoting the religion of the particular learner, which would be against the school policy and the Establishment Clause (McKenney, 1995). Besides, if I mark and grade the essay as fail, the student may similarly accuse me of belittling their religion.
