Equality in education in the United States has been controversial for a long period since the days of segregation based on race and other ethnographic factors. In recent times, the country has made significant strides in promoting Equal Protection Clause of the 14th Amendment in the educational sector to provide every child with access to equal and quality education. However, the Supreme Court’s ruling on Brown v. Board of Education (1954) has hindered equal protection in schools by allowing segregation provided the practice is not based on a discriminatory intent. The decision has led to rise of ability grouping or tracking, a form of segregated school or classroom system in which students are placed and taught in clusters according to the ability or potential to learn (Kiss, 2017). Even though ability grouping is highly effective in advancing efficacy in learning because students with equal capacity are subject to concepts they can comprehend based on their cognitive functioning ability, it reinforces inequality and discrimination in schools since other factors than the student influence learning.
