The balance between the violations of student privacy verse the need for the education institution to protect everyone within the institution has recently been a topic of debate. While school lockers are a property to the learning institution, Students deserve their privacy, and so does the school deserve to protect itself from any susceptible harm. Thus institutions should randomly conduct inspections on the students' lockers and bag packs with certain regulations as they carry out the practice.
According to the fourth amendment under the Rehnquist Court, "the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures." (Davey & D, 2020)According to the fourth amendment, institutions such as schools are to be regulated in unreasonable searches as it is viewed as violating privacy. However, the rampant rise in school insecurities has led to the debate over the fourth amendment regarding student privacy. A case study such as that of a Colombian student known as folk whereby his bag pack was found to have bullets and a further search of his other bag to have a gun. Though the court ruled in his favor, the possession of such war items within the institution endangers other students and personal within the institution. It should be thus highly recommended that even the law enforces the need to search students in a regulatory manner as a security precaution.( Kolbe& L, 2020).
